Workers’ Comp in Ventura County Help For Injured Workers

urt at work anywhere in Ventura County? You’re entitled to medical treatment and wage replacement while you recover, and—if your injury leaves lasting problems—a permanent disability award based on your Whole Person Impairment. Below is a plain-English roadmap that applies whether you live in Oxnard or Piru.

Areas we serve in Ventura County

Camarillo, Fillmore, Moorpark, Ojai, Oxnard, Port Hueneme, San Buenaventura (Ventura), Santa Paula, Simi Valley, Thousand Oaks, plus unincorporated communities like Oak View, El Rio, Channel Islands Beach, Meiners Oaks, Piru, Casitas Springs, Nyeland Acres, and Somis.

Temporary Total Disability (TTD): Getting paid while you can’t work

TTD replaces part of your wages when your work injury temporarily takes you off the job.

  • When it starts: Your treating doctor places you off work or gives restrictions your employer can’t accommodate.

  • How it’s calculated: Generally two-thirds of your average weekly wage (AWW), subject to statewide minimums and maximums that change yearly. We audit your wage records (overtime, multiple jobs, seasonal swings) to maximize AWW.

  • How long it lasts: Up to 104 weeks within a five-year window for most injuries. Certain serious injuries (for example, severe burns, amputations, traumatic brain injuries, and some high-velocity eye injuries) can qualify for up to 240 weeks.

  • When it stops: You return to work, your doctor clears you, or you reach Maximum Medical Improvement (MMI). If the insurer cuts off TTD early or pays late, we push for reinstatement, penalties, and interest where appropriate.

Quick tip: Keep copies of every work-status note. If HR can’t place you in modified duty, ask for that in writing—it helps lock in TTD.

Whole Person Impairment (WPI) and your permanent disability

When your condition stabilizes at MMI, the focus shifts to permanent impairment and the dollars tied to it.

  • AMA Guides, 5th Edition: California uses the AMA Guides, Fifth Edition, to measure WPI (0–100%). The QME/AME or your PTP assigns an impairment value by body region and condition, then combines multiple impairments using the Combined Values Chart.

  • Converting WPI to a rating: Your WPI is converted to a permanent disability (PD) rating under the state schedule. The rating adjusts for age and occupation; for newer-date injuries, a standard modifier applies. This final percentage drives the duration and dollar value of PD payments and the potential for a lump-sum compromise or stipulated award.

  • Why the examine matters: The quality of your WPI write-up can swing a case value dramatically. We prep clients for the QME, submit targeted medical records, diagnostic studies, and lay statements (job duties, lost hobbies, pain impact) so the physician measures everything that should count.

Common Ventura County injuries we handle

Agriculture and packing work in Santa Paula and Somis; port, warehouse, and logistics in Port Hueneme and Oxnard; manufacturing in Simi Valley and Camarillo; construction and trades across Thousand Oaks and Moorpark; retail and service across Ventura and Ojai. We also see a high volume of cumulative trauma from repetitive lifting, driving, tool use, and prolonged standing.

Typical timeline

  1. Report the injury and request a DWC-1 claim form.

  2. Start treatment and obtain a work-status note.

  3. If off work or no modified job is available, TTD should begin.

  4. If treatment is denied or stalled, we challenge UR/IMR and, when needed, request a QME.

  5. At MMI, the doctor issues an impairment report. We rate it, push back on errors, and negotiate your PD benefits or settlement.

Denied or delayed?

Delays in starting TTD, lowballed AWW, UR denials, or a sloppy impairment report are fixable problems with the right record and the right doctor. Our team handles cases filed at (and venued to) the Oxnard WCAB and surrounding boards; we move fast on penalties, expedited hearings, and medical-legal strategy when insurers slow-roll a claim.

Talk to an attorney early

Early involvement lets us set the wage record, direct you to the right treating doctor, and make sure your QME is in the correct specialty. That usually means higher TTD, cleaner medical approvals, and a stronger WPI.
